ORDER

1. Heard
learned Advocate Padmraj K Jadeja for the applicant. Learned
Advocate invited attention of the Court to page Nos.8, 10, 12, 25, 27
and 30 at which various Annexures are placed showing the ‘attitude of
a Government Officer’ which sufficiently reflects the ‘respect’ the
concerned Officer is having for the ‘Judicial System’ and the Order/s
passed by the competent Court – in this case the High Court.

2. Looking
to the seriousness of the matter, it is directed that the concerned
Officer who is signatory to letter dated 16/09/2011-the Deputy
Executive Engineer, Irrigation Sub Division, Gondal shall personally
remain present before this Court on 21/10/2011 i.e. tomorrow at
11:00 a.m., failing which the Court will have no other option
than to pass coercive order/s.

3. It
will be open for the concerned Officer to comply with the order dated
18/02/2011 which was reiterated by this Court while passing order in
CA No.5407 of 2011 on 12/05/2011 before coming to the Court so as
absolve him from the consequences arising from the conduct reflected
from the aforesaid annexures to the Civil Application.

4. Direct
Service is permitted today. It will be open for the learned
Advocate for the applicant to communicate this order to the opponent

– org. petitioner by Fax and/or through Speed Post or courier
at the cost of the applicant.

5. A
copy of this order be made available to learned Assistant Government
Pleader Mr.Rindani for its onward communication.
