ORDER

Upon
the matter being listed today pursuant to the report dated 16.10.2008
of Deputy Registrar of the Criminal Department, it was submitted by
learned A.P.P. Mr. L.R.Poojari that the petition was required to be
finally heard and disposed at the earliest in view of the
difficulties arising out of the Record and Proceedings lying with the
Court. At one stage it was suggested that, pending final hearing, the
R & P may be returned for the purpose of proceedings of
departmental action pending in the District Court, Vadodara. It was
further submitted by learned A.P.P Mr. Poojari that at present papers
of the present petition were not supplied to him as they were missing
in the office of learned A.P.P. He also submitted that there were so
many such matters wherein their papers were missing and not available
due to which learned A.P.P is required to seek adjournment or abstain
from rendering any assistance to the Court. He sought time of two
weeks for obtaining necessary copies from the Court so as to complete
his record and assist the Court for final hearing. Hence, S.O. to
01.12.2008 with the direction that the matters may be listed for
peremptory final hearing
at the bottom of the first board.
