By the Court:

The learned counsel for the petitioner

argued that petitioner is in custody since last

more than 4 moths; charge sheet has been filed;

the quantity of contraband recovered is lessor

than the commercial quantity, therefore, he be

released on bail.

The learned PP, on the basis of case

diary, contended that apart from the quantity

of contraband recovered in the present case

which is more than lessor quantity, the

petitioner is a habitual offender and as many

as twenty-six cases were registered against

him, wherein in most of the cases, he was

convicted and at present three cases are still

pending against him.

After considering all the facts and

circumstances of the case; the quantity of

contraband recovered in the present case and

further that petitioner appears to be habitual

offender, I am not inclined to allow this

application and the same is, accordingly,

dismissed.
