The petitioner has sought quashing of

the First Information Report bearing Patna

S.C./S.T. P.S.Case No. 40/80 dated 20.12.08.

The petitioner submits that in the

facts of the case, no case punishable under

the S.C/S.T Act would be made out. These are

matters to be considered by the Investigating

Agency which I expect him to do.

                           With       these     observations            the

                  application is disposed of.
