2. 03-11-2011 In this appeal, we are not required to go into merits

of the appeal because the parties are in agreement that

pursuant to order under appeal passed by the Writ Court, the

respondent/University has already taken a fresh decision in

the matter which has been challenged by the appellant

through an independent writ petition which is pending.

In view of the aforesaid learned counsel for the

appellant prays to withdraw this appeal and seeks liberty that

he may raise the issues in the pending writ petition, if

required.

The prayer to withdraw this appeal is allowed and the

appeal is dismissed as withdrawn with the liberty aforesaid.
