Heard, learned counsel for the petitioner.

By this petition, petitioner has prayed for a mandamus directing the trial
court to decide the R.M. No.159/2009. A perusal of the Order Sheet indicates
that the application has been filed only on 08/12/2009 in which 30/1/2010 was
the date fixed by the Court below. We see no occasion to file a writ petition
when the application has already been entertained and the trial court is
proceeding with the application.

With the aforesaid observation writ petition is dismissed.
