While issuing notice of motion, the following order was
passed by this Court on 24.3.2009:-
“Learned counsel for the petitioner has submitted
that earlier the matter was inquired by the police. Proceedings
under Sections 107/151 of the Code of Criminal Procedure
were initiated and the same terminated after the expiry of a
period of six months. Thereafter, the complainant filed a
private complaint. Before the summoning order could be
passed, the petitioner had proceeded to Dubai and hence, did
not know about the criminal proceedings.
Notice of motion for 5.5.2009.
The petitioner is directed to surrender before the
trial Court on or before 4.4.2009 and he shall be released on
interim bail subject to the satisfaction of the said Court. “
Learned counsel for the petitioner has submitted that in
pursuance of above order, the petitioner has surrendered before the
trial Court on 28.3.2009 and has been released on interim bail.
Accordingly, this petition is allowed and the order granting
interim bail dated 24.3.2009 is made absolute.
