Learned
counsel appearing for the appellants states that the respondent has
been reinstated which is not disputed by the learned counsel
appearing for the respondent. Learned counsel for the appellant has
placed reliance on the decision of the Apex Court in Jagbir
Singh v. Haryana State Agriculture Marketing Board and Another, 2009
Labour and Industrial Cases 3366 and has urged that
only compensation ought to have been awarded to the respondent. In
view of the aforesaid decision of the Apex Court, the appellants are
entitled to interim order. The effect and operation of the award
dated 26.8.2010 passed by the Presiding Officer, Labour Court, Dahod
in reference (LCD) 794 of 2008 shall remain stayed so far as back
wages are concerned. This Civil Application stands disposed of.
