The transfer petition has been filed under section 24 of

the CPC. At the time of hearing, learned counsel for the

respondent submitted that the proceedings are not pending before

the court below and it has been disposed as early on 30.3.2009. A

copy of the order passed against the present petitioner exparte in

the above proceedings is handed over for my perusal. Since no

O.P. is pending as on the date of filing of the transfer petition, it is

only to be dismissed. I do so.
