The State has approached this court through the present appeal
for reduction in the compensation for the acquired land.
Briefly, the facts are that vide notification dated 27.9.1993,
issued under Section 4 of the Land Acquisition Act, 1894 (for short, ‘the
Act’), the State of Punjab acquired land in the revenue estate of Village
Barriar, Tehsil and District Gurdaspur for construction of a building for the
establishment of an Engineering College at Gurdaspur. The Land
Acquisition Collector vide his award dated 30.11.1995 assessed the market
value of the land at Rs. 3,00,000/- per acre. Dissatisfied with the award of
the Land Acquisition Collector, the landowners/claimants filed objections.
On reference under Section 18 of the Act, the learned court below
determined the market value of the acquired land at Rs. 3,20,000/- per acre.
Learned counsel for the parties submitted that the claim in the
present appeal is squarely covered by judgment of this court in R. F. A.
No. 1628 of 2000 Gurdeep Singh and another vs The State of Punjab and
another decided on 17.11.2008, whereby the award of the learned counsel
below was upheld.
Since this court had upheld the award of the learned court
below in Gurdeep Singh’s case (supra), the present appeal does not survive.
Accordingly, the same is dismissed.
