Jharkhand High Court
Purno Chandra Gaur vs Luthi Gour on 23 September, 2011
IN THE HIGH COURT OF JHARKHAND AT RANCHI
Civil Review No. 105 of 2004
Purna Chandra Gaur ..... Petitioner
Versus
Luthi Gaur ..... Respondent
-----
CORAM: HON'BLE MR. JUSTICE NARENDRA NATH TIWARI
-----
For the Petitioner - Mr. Md. Hatim, Sr. Adv.
For the Respondent - Mr. T.Kabiraj
-----
10/23.9.2011
Learned counsel for the petitioner submitted that the heirs were the necessary
party, but they could not be substituted. This civil review was abated and for that
purpose an interlocutory application was filed, but the same was rejected.
Learned counsel for the respondent submitted that in view of the said
abatement, this civil review has become infructuous.
I find substance in the said submission of learned counsel for the respondent.
This civil review is, accordingly, dismissed as becoming infructuous.
