Prayer: This petition has been filed seeking for a writ of Mandamus, forbearing the respondents from preparing the panel and effecting promotions to the post of Assistant Divisional Engineer in the Highways Department in any manner except on the basis of the seniority list of Engineers which has been prepared as on 01.01.2004 and circulated in June 2004.

O R D E R

Heard the learned senior counsel representing the learned counsel appearing on behalf of the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents.

2. At this stage of the hearing, the learned counsel appearing for the petitioner had submitted that it would suffice if the petitioner is permitted to make a representation to the first respondent, with regard to seniority of the petitioner, as prayed for, in the present writ petition and if the first respondent is directed to dispose of the same, on merits and in accordance with law, within a specified period.

3. The learned counsel appearing on behalf of the respondents has no objection for this Court passing such an order.

4. In view of the submissions made by the learned counsels appearing for the parties concerned, the petitioner is permitted to make a representation to the first respondent, within a period of four weeks from the date of receipt of a copy of this order, and on such representation being submitted, the first respondent is directed to dispose of the representation, on merits and in accordance with law, within a period of twelve weeks thereafter.

5. With the above directions, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed.
