Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the first respondent herein to close the unlicenced cycle stand run by the said T.Vellaiyan at D.No.3/24, Bharathi Road, Perambur, Chennai-11 and also to remove the cows kept therein.

 O R D E R

Heard Mr.P.Madhan, the learned counsel appearing for the petitioner and Mr.V.Bharathidasan, learned counsel appearing for the first respondent and Mr.R.Sivakumar, learned counsel appearing for the second respondent.

2. Even though the prayer in the writ petition is for a larger relief, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if the first respondent is directed to dispose of the representation of the petitioner, dated 12.11.2009, on merits and in accordance with law, within a specified period.

3. The learned counsels appearing on behalf of the respondents, have no objection for such an order being passed by this Court.

4. In view of the submissions made by the learned counsels appearing on behalf of the parties concerned, the first respondent is directed to dispose of the representation of the petitioner, dated 12.11.2009, after giving an opportunity of hearing to the petitioner, as well as to the second respondent, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. The petitioner is directed to furnish a copy of the representation, dated 12.11.2009, to the first respondent, along with a copy of this order. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.

5. Accordingly, the writ petition is disposed of, with the above directions. No costs. Consequently, connected miscellaneous petition is closed.
