Heard learned counsel for the petitioner and Sri Satish Kumar Rai
for the respondent no.4.

Against the dismissal of the claim petition of the petitioner Writ
Petition No. 9944 of 2007 is already stated to be pending. The
relief claimed in the present petition is against the recovery
proceedings initiated on the basis of recovery certificate dated
30.7.2009 which is based on the proceedings under challenge in
the said petition. In this view of the matter the petitioner may file
an amendment application in the same petition for the relief
claimed herein.

The petition is hereby dismissed on this ground.
