05. 13.04.2011 Against the orders of this Court dated

17.9.2009 passed in C.W.J.C. No.12403 of 2009 the

authorities have passed order bearing memo no.262

dated 9.12.2009, Annexure-B to the show cause filed

by the Superintendent of Police, Motihari, perusal

whereof indicates that the appointment process

pursuant to Advertisement No.1 of 2004 had come to

an end on 27.7.2008. Aforesaid order also refers to

another order of the High Court dated 24.4.2009 passed

in C.W.J.C. No.5230 of 2009, which is annexed as

Annexure-B to the show cause filed on behalf of

respondent no.7. It is thus, evident that the orders of

this Court dated 17.9.2009 has been complied with.

The contempt petition is, accordingly,

disposed of however, with liberty to the petitioners to

either challenge the order dated 9.12.2009, Annexure-B

on the ground that against the orders of this Court dated

24.4.2009 passed in C.W.J.C. No.5230 of 2009 Letters

Patent Appeal Nos.831 of 2009 and 1214 of 2009 is

pending. In the event, order dated 9.12.2009 is not

challenged then the same shall be subject to the result

of the aforesaid two LPAs.
