The appellant was a person included in the select list

published by the Food Corporation of India for appointment to

the post of Deputy Manager – General Administration. The said

list was cancelled by the Union of India as per Annexure-B

document produced along with this writ appeal. Fresh steps were

taken for recruitment of candidates to the above said post. In the

above background, this writ petition was filed claiming

appointment based on his inclusion in the earlier select list

published by the Food Corporation of India. The validity of the

order of the Union of India cancelling the select list has been

upheld by the Apex Court in the decision reported in Food

Corporation of India and others v Bhanu lodh and others

(AIR 2005 SC 2775). The appellant points out that several

contentions raised by him in this appeal were not raised or

considered in that decision. But we cannot go into such

contentions as the validity of the cancellation of the first select

list was already upheld by the Honourable Supreme Court in the

decision mentioned above. Accordingly, the writ appeal is

dismissed.
