Heard learned counsel for the applicant, learned AGA for the State and
perused the record.
Learned counsel for the applicant submitted that from perusal of
statement of prosecutrix it appears that she herself went along-with
applicant, who was studying along-with her. According to medical
report, she was above 18 years of age. There was no injury on any part
of her body. However, under pressure of family members the allegation
was made that against her wishes physical relationship was established.
In the present case, the applicant is in jail since 24.2.2010.
In view of the above, without expressing any opinion on merit, it is a fit
case for bail. Let the applicant Rahees be enlarged on bail on his
furnishing a personal bond with two sureties each in the like amount to
the satisfaction of court concerned in Case Crime No. 94 of 2010, under
Sections 363, 366, 376 IPC, P.S. Surajpur, District Gautambudh Nagar.
