Heard learned counsel for the applicant, learned A.G.A.
and perused the record.
Learned counsel for the applicant submitted that
showing two cases in the gang chart the applicant has
been challanned under the provision of Gangster Act in
which the applicant is on bail. He further contended that
if the applicant is released on bail, he will not abscond
and misuse the liberty of bail. However, in the present
case the applicant is in jail since 8.5.2010.
Learned A.G.A. opposed the aforesaid prayer of bail.
In view of the above, without expressing any opinion on
merit, it is a fit case for bail.
Let the applicant Rahul Kurmi be enlarged on bail on
his furnishing a personal bond with two sureties each in
the like amount to the satisfaction of the court
concerned in Case Crime No.357 of 2010 under Section
3(1) of the U.P. Gangster & Anti Social Activities
(Prevention) Act, 1986, PS. G.R.P. Kanpur Nagar,
District Kanpur Nagar.
