Heard learned counsel for the petitioners.
It is stated that against the order dated 26.12.2009 passed by Deputy
Director of Consolidation (Administration), Azamgarh which is impugned in
the instant writ petition, the petitioners have already filed restoration
application before the Deputy Director of Consolidation (Administration),
Azamgarh. A certified copy of said restoration application has been brought
by learned counsel appearing for the caveator before the Court and I have
perused the same. In this view of the matter, writ petition stands dismissed
with liberty to the petitioners to pursue their remedy before Deputy Director
of Consolidation (Administration), Azamgarh in pending restoration and the
Deputy Director of Consolidation (Administration), Azamgarh is directed to
decide the said restoration application expeditiously, preferably within a
period of two months from the date of production of certified copy of this
order before him.
Till disposal of above restoration application, the order dated 26.12.2009
passed by Deputy Director of Consolidation (Administration), Azamgarh shall
be kept in abeyance.
