Heard learned counsel for the petitioner.
It is stated that against the order dated 21.11.2009 passed by Consolidation
Officer in Case No. 724 in respect of Khata No. 424 of the Village Sandpur,
Tappa Dubauliya, Pargana Amodha, Tehsil Harraiya, District Basti, appeal
No. 1331 of 2010 (Raj Bahadur Vs. State of U.P. and another) under Section
11 of U.P.C.H. Act has been filed by the petitioner, which is still pending.
The petitioner has also moved application for staying the order passed by
Consolidation Officer.
In the circumstances, the Appellate Authority is directed to decide the said
appeal after hearing the parties expeditiously, preferably within a period of six
months from the date of production of certified copy of this order before him.
Till then, the petitioner shall not be dispossessed from the plots in dispute and
respondents are restrained from allotting or any way dealing with the plots,
which are subject matter of dispute.
With the aforesaid observation and direction, writ petition stands disposed of
finally.
