2 4.3.2011 1. Heard learned counsel for the petitioner and learned

counsel for the respondent.

2. This writ petition has been filed by the petitioner for

directing the respondents to pay the admitted dues for the work done by

him in the Female Ward under Renovation work of T.B Senotarium at

Koilwar in the district of Bhojpur along with earnest money and

interest.

3. Considering the facts and circumstance of this case, this

writ petition is disposed of with a liberty to the petitioner to file an

application before the Chief Engineer Building Construction

Department Government of Bihar (Respondent No. 3) with respect to

his claims along with a copy of this order. If such an application is filed

the said authority shall decide the same and shall pay all the admitted

dues, earnest money and interest to the petitioner immediately

thereafter. However, if any amount of dues earnest money and interest

is not admitted the said authority shall pass speaking order with respect

thereto against which the petitioner will have liberty to approach the

appropriate Forum.
