For the reasons stated therein, this application is

allowed and Cr. Misc. No. 33377/2008 is restored to its original

file.

As per the order of this court, the quashing

application was to be heard on merit with the restoration

application.

Call for the clear copy of the case diary of

Madhubani Town PS Case No. 55/1995 from the court of the

Chief Judicial Magistrate, Madhubani and put up the quashing

application on receipt of the case diary.
