                  ------------------------------------------
                    Bail Appl.No. 3843 of 2008
                  ------------------------------------------
Dated this the 23d day of June, 2008.

                               ORDER

Petition for bail.

2. The alleged offences are under Sections 457, 461, 380

and 34 of IPC. Petitioner is the accused in the crime.

3. This petition is opposed. Learned Public Prosecutor

submitted that petitioner is an accused in similar other four cases.

4. Learned counsel for the petitioner submitted that

petitioner is granted bail in two other cases and he is prepared to

abide by any conditions. He has been in custody for 90 days. Since

charge is laid, petitioner’s detention is not required for the purpose of

investigation. Petitioner is implicated in false cases after his arrest, it

is submitted.

5. On hearing both sides, I find that bail can be granted to the

petition on stringent conditions.

Hence, bail is granted to the petitioner on the following terms

and conditions:

[B.A.3843/08]

i) The petitioner shall execute a bond for Rs.1,00,000/-

with two solvent sureties each for the like sum to the

satisfaction of the learned Magistrate.

ii) Petitioner shall report before the investigating officer on

every alternate day between 10 A.M. and 1 P.M. until

further orders.

Iii) Petitioner shall not tamper with evidence, influence or

threaten any witnesses and in case of breach of this

condition, bail is liable to be cancelled.

iv) Petitioner shall not leave the limits of the police station

within which crime is registered, except with the prior

permission of the Magistrate court concerned.

v) In case petition is involved in offence of similar nature

while on bail, bail is liable to be cancelled.

Petition is allowed.
