The
counsel for the respondent – State, on instructions, submits
that as the petitioners were admitted in the Dental Colleges, they
could have been called for re-shuffling till the cut off date i.e.
30.9.2010, as was fixed by the Supreme Court. By the cut off date
i.e. 30.9.2010, three counselling having made, the petitioners were
called for in the third counselling. By that time, there was no seat
available. Newly created and approved seats in the Ayurved and
Physiotherapy courses were made available after 30.9.2010. At that
time, the fourth counselling was done. As those students admitted
in the Ayurved and Physiotherapy courses, for them, the cut off date
prescribed is 31.10.2010, those persons were called for in the fourth
counselling. The petitioners could not have been called for in the
fourth counselling as otherwise the seat in the Dental College which
would have fallen vacant if the petitioners would have taken
admission in the Ayurved and Physiotherapy courses, would not have
been filled up by any other persons on the cut off date of 31.10.2010
having elapsed. That is the reason those who were admitted in the
Medical and Dental Colleges were not called for further counselling
after 30.9.2010.

The
learned counsel for the State Government prays for and is allowed a
week’s time to file further affidavit in the line as orally submitted
today.

Post
the matter on 13th December, 2010.
