Heard learned counsel for the parties.
The petitioner is aggrieved against the order dated 15.5.2008 byl
which his two applications have been rejected by the trial court and
plaintiff’s permission to produce the copy of the map was denied and his
prayer for summoning the map from the Municipal Board was also
rejected.
After going through the facts of the case and the contents of the
applications, it is not a fit case for exercise of jurisdiction under Article
227 of the Constitution of India in said order. Therefore, the writ
petition is not entertained. However , the petitioner shall be free to
challenge the said order dated 15.5.2008 in appeal in case any occasion
arises for the petitioner to do so.
The writ petition is, therefore, dismissed with above liberty.
