learned Senior Advocate Mr.Mihir Joshi with learned Advocate
Mr.Nirzar S.Desai for the petitioner.

Learned
Advocate Mr.P.V.Hathi with learned Advocate Ms.Khyati P.Hathi appears
on caveat for respondent Nos.1(A), 1(C) and 1(D) and prays for time.

2. Taking
into consideration the nature of the controversy involved in the
matter, the request for time is declined. The learned Advocate may
file reply on or before returnable date.

3. Having
heard the learned Senior Advocate for the petitioner, the Court is of
the opinion that the matter requires consideration.

4. RULE.

NOTICE as to interim relief returnable on 07.03.2011.
Ad interim relief in terms of para-19[D](a),
subject to the Trust being permitted to incur expenses up to
Rs.5,000/-, but the payment must be made by ‘Account Payee Cheque’.
Besides that, the Trustees are directed to place statement of the
expenses incurred every two months before this Court. Ad
interim relief also in terms of
para-19[D](g) & (h).

Learned
Advocate for the petitioner is requested to supply a copy of this
petition to learned AGP Mr.H.K.Patel for being forwarded to the
Secretary, Legal Department for his consideration in the matter,
wherein the order passed by the same officer is under consideration.

A
copy of this order be made available to learned AGP Mr.H.K.Patel for
its onward communication.
