12. 03.02.2011 The petitioner is in custody in relation to Khanpur

P.S. Case No. 30 of 2009 instituted under Sections

406,420,467,468,471 and 120(B) /34 of the Indian Penal Code.

The allegation in the First Information Report is that

the informant, who claims himself to be running a private School

by one time, he alleged that Shivji Prasad Mahto and Arjun

Prasad along with other accused called a meeting of guardian

and students and the petitioner being Director of an institution

and another Ramashish Mahto, who is said to an advisor and

one who is said to be founder of Saksharta Abhikyan,

Samastipur. In the said meeting, it was said that they used to be

computer education by arranging a camp for one month to

economically weak students of rural areas. He further alleges

that the petitioner had started a computer education course but

is cheating the public. Having considered the matter, in my view

these are the matters of pure civil dispute in nature and the

people, who are said to have been cheated are free to

approach the Court for redressal of their grievances, none has

come.

In that view of the matter, in the event of arrest or

surrender within one month from the date of receipt/production

of a copy of this order in connection with Khanpur P.S. Case

No. 30 of 2009 above named, petitioner shall be released on

bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with

two sureties of the like amount which to the Satisfaction of

learned Chief Judicial Magistrate, Samastipur subject to the

conditions as laid down under Section 438 (2) of the Cr.P.C.
