ORAL ORDER
1. This
petition under Article 226 of the Constitution of India has been
filed, with the following prayers :
“This
Hon’ble Court may be pleased to issue a writ of mandamus or any other
writ, order or direction :
A) Directing
the respondent no.2 to transfer the petitioner at his original place
and post at Amreli-2 Division Office forthwith.
B) In
the alternative, the respondent no.2 may be directed to decide the
representation of the petitioner dated 11.4.2011 within a period of
two weeks after giving an opportunity of hearing.
C) During
the pendency and final disposal of this petition, the
Respondent No.2 may be directed to decide the representation of the
petitioner dated 11.4.2011.
D) To
grant such and further relief a may be deemed fit and proper.”
2. At
the very outset Mr.A.S.Supehia, learned counsel for the petitioner
states that the interest of justice would be met if the petitioner is
permitted to make a fresh representation to respondent No.2, who may
be directed to consider and decide the same within a stipulated
period of time.
3. Upon
the above statement being made by the learned counsel for the
petitioner, the following order is passed :
The
petitioner is permitted to make a fresh representation to respondent
No.2, within a period of two weeks from today. If the representation
is made within the stipulated period of time, respondent No.2 shall
consider and decide the same, in accordance with law, within a period
of two months from the date of receipt of the representation.
It
is clarified that while passing this order, the Court has not entered
into the merits of the case.
The
petition is disposed of, in the above terms.
Direct
service of this order is permitted.
