Heard
Mrs.Shilpa R. Shah, learned counsel appearing for the applicant.

It
is the say of the applicant that he is absolutely an innocent person
and under constant threat and harassment, he is compelled to leave
his native place Surat City and he is trying to establish himself at
Ahmedabad. It is very likely that if the investigation is honest and
fair, the Police may file ‘B’ summary with prosecution against the
orig. complainant Jhariwala. Therefore, the applicant may be
permitted to withdraw this application with a liberty to approach
this Court again afresh on the same cause.

Earlier
one petition was preferred by the applicant but the same was
withdrawn on the ground that certain relevant documents were not
with the applicant.

After
some deliberations, Mrs.Shilpa R. Shah, learned counsel appearing
for the applicant, is permitted to withdraw this application with a
liberty to approach this Court again afresh on the same cause if the
Police tries to put up a case against the application.

So
without entering into the merits of the present application and the
submissions made, the applicant is permitted to withdraw this
petition with aforesaid appropriate liberty.
