This recall application has been moved by the learned counsel for the
petitioners on the ground that some Government Orders has been set aside by
Lucknow Bench of this court. Special appeal and SLP have also been
dismissed, therefore, they are also entitled to the same benefits.

Since learned Single Judge has not entertained the writ petition and relegated
the petitioners to avail alternative remedy therefore, our judgment dated
5.10.09 sought to be recalled is correct.

Therefore, recall application is rejected. However, it is open to the petitioners
to seek the same relief before the Labour Court which is bound by the
judgment passed by Lucknow bench of this Court.
