This petition has arisen out of a telegram sent by one Hari Lal residence of
Haiderganj, Police Station Kotwali Nagar District Faizabad to the Chief
Justice, Allahabad High Court, Lucknow Bench, Lucknow. The complainant
in the telegram has alleged that Police of Police Station Kotwali Nagar,
District Faizabad had picked up his son Raj Kumar Yadav on 19.5.2010 at
about 7.00 to 8.00 p.m. from his residence and took him to the police station
where he was illegally detained by the police without any criminal case.
Counter affidavit on behalf of the State has been filed by Sri R.K.S. Rathaur,
the Superintendent of Police, District Faizabad, in which it has been stated by
the deponent that the accused was arrested by the police of Police Station
Kotwali Nagar, District Faizabad who was wanted in case Crime No.2436 of
2010 under Section 302 I.P.C. He was arrested by the Investigating Officer
on 22.5.2010. The accused was produced before the Magistrate concerned
who remanded him to judicial custody and he is still in jail.
In view of the affidavit filed by the Superintendent of Police, it does not
appear to be illegal case of detention. No further action is required in the
matter. The habeas corpus petition is dismissed.
