: HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)

Learned counsel for the appellant submits that
the appellant is ready to pay total dues to the respondent-Bank with
interest @ 16.5% per annum, as agreed upon; except penal
interest, as they have charged. He further states that the appellant
is ready to pay such dues in installments and he is ready to pay Rs.
1,00,000/= [Rupees One Lac] within a month. In view of such
stand taken by the counsel for the appellant, let notice be issued on
respondent-both in the matter of L.P.A and Civil Application. Direct
notice is permitted. Post the matter on 25th January 2011.
In the meantime, the petitioner may deposit a sum of Rs. 1,00,000/=.
