Allahabad High Court
Raju Prasad Maurya vs State Of U.P. And Others on 9 August, 2010
Court No. - 18

Case :- WRIT - A No. - 46846 of 2010

Petitioner :- Raju Prasad Maurya
Respondent :- State Of U.P. And Others
Petitioner Counsel :- R. C. Maurya
Respondent Counsel :- C. S. C.

Hon'ble V.K. Shukla,J.

Petitioner has approached this Court contending therein that he had
applied for BTC Course-2010 as OBC Male for Science Group. In the
list which was so finalized in male general science group, his name
was shown at serial No.27 and the names of Sunil Kumar Verma and
Sunil Kumar Yadav were shown at serial Nos. 30 and 31 respectively,
based on the quality point marks. Petitioner’s quality point mark is
207.93, whereas quality point marks of Sunil Kumar Verma and Sunil
Kumar Yadav are 206.61 and 206.20 respectively. Petitioner’s
contention is that in spite of the fact that his merit status is higher than
Sunil Kumar Verma and Sunil Kumar Yadav, they have been accorded
admission in Government institution against free seat, whereas he has
been accorded admission in private institution against paid seat.

Entire exercise for admission has been taken by the Member
Secretary, District Selection Committee, who also happens to be the
Principle of District Institute for Education and Training, Bhadohi. In
such a situation and in this background, as entire records are available
with the said authority, the said authority is directed to examine the
claim of petitioner and take appropriate decision, in accordance with
law, by means of reasoned and speaking order, within four weeks from
the date of receipt of a certified copy of this order.

Writ petition stands disposed of accordingly.
