3. 21.01.2011 Heard learned counsel for the petitioners and learned

counsel for the State.

Petitioners are alleged for causing assault to members of

Barat Party, snatching their attachee with ornament, chain and ring

of bridegroom and someone another is said ornamental. Specifically

it is submitted that misbehavious act on behalf of the Barat party

was opposed by villagers and only to cast pressure, this allegation is

leveled. For the offence under section 3 (1) (x) of scheduled castes

and scheduled tribes (Prevention and atrocities) Act. Submission of

the learned counsel for the petitioner is that there is no specification

as who from accused persons really abused in name of caste.

Taking this into consideration, in the event of arrest or

surrender within one month from the date of receipt/ production of a

copy of this order in connection with Kasma P.S. Case No. 34 of

2010, above named, petitioners shall be released on bail on

furnishing bail bond of Rs. 10,000/-(ten thousand) each with two

sureties of the like amount which to the satisfaction of Chief Judicial

Magistrate, Aurangabad subject to the conditions as laid down under

section 438(2) of the Cr.P.C.
