ORAL
ORDER

The
petitioner has preferred the petition for challenging the action of
the respondent ONGC for not continuing with the licence of the
petitioner on the same terms and conditions as it was given to
Arihant Store.

When
the matter was heard, Mr.Patel, learned Counsel appearing for the
petitioner, declared before the Court that as the possession is
already taken over, he is not pressing the challenge to the action
for non-renewal, however, he submitted that the ONGC has to follow
the procedure of inviting the tenders for allotment of the shop on
licence basis and the said procedure is not undertaken and it has
been directly given to Arihant Store.

Whereas,
on behalf of the respondent ONGC, it was submitted by Mr.Mehta that
it has been given to Arihant Store by way of temporary measure,
since the residents of the colony may not suffer. However, it was
declared that the procedure for inviting tenders shall be undertaken
and the process shall be completed within four months from today.

In
view of the above, no further order is required, except observing
that the ONGC shall abide by the declaration made before this Court.
The petitioner is disposed of accordingly.
