03/ 15-Sep-2010 Heard learned counsel for the petitioner and

learned counsel for the State.

2. The grievance of the petitioner raised

through a Criminal writ petition was that his son aged

about 14 years is traceless and has been abducted by

some persons but the police is not taking action to

recover the boy. The writ petition was disposed of with

a direction to the Superintendent of Police, Samastipur

to personally supervise the investigation into

Bibhutipur P.S. Case No. 160 of 2009 dated

23.06.2009.

3. The stand of the State is that after

thorough investigation the police has found the case to

be false and according to the conclusions drawn by the

police the boy has been kept concealed by the family

members with a view to support false allegations

against others.

4. Learned counsel for the petitioner wants

us to punish the Opposite Parties for disobedience of

the order passed in the writ i.e., Cr.W.J.C. No.1003 of

2009 disposed of on 17.12.2009.

5. We find no good materials to accept the

aforesaid submission. The contempt application is

dismissed.

6. This order shall not prejudice the

petitioner in seeking remedy before appropriate

authority in accordance with provisions of Cr.P.C.
