Heard learned counsel for the petitioner and learned Standing Counsel.
Notice on behalf of opposite parties no.1 to 6 has been accepted by the
learned Standing, who prays for and is granted four weeks’ time for filing
counter affidavit. Petitioner may file rejoinder affidavit within two weeks
thereafter.
List after expiry of the aforesaid period.
Submission of learned counsel for the petitioner is that in pursuance to the
transfer order, the petitioner has joined in the month of December 2009 in
spite of that the opposite parties are enumerating one of the charges in respect
of non-joining and the petitioner has been placed under suspension. The other
charges are general in nature. Therefore, he submits that the suspension of the
petitioner is bad in law. He also submits that the petitioner has earlier moved
a complaint against Sri Gendan Lal, Under Secretary and he was arrayed as a
party and at his behest earlier also the petitioner was suspended and he filed a
writ petition in this regard and suspension order was stayed. It is also alleged
that at his persuasion again the petitioner has been placed under suspension.
Considering the aforesaid facts, the suspension order dated 7.4.2010,
Annexure No.1 to the writ petition, shall remain stayed till the next date of
listing.
