Heard learned A.G.A. for the State and perused the record.
As per the prosecution case injured Sonam daughter of the
applicant continued to meet boys. One day the applicant saw that
one boy Pintoo coming out from the house. Hence he was
annoyed. Firstly he beat his daughter, injured Sonam, and then
with the intention to kill tried to cut her neck by the knife. The first
information report was lodged by his wife, Smt. Pushpa, mother of
the injured. According to medical report, injury of knife was
found on neck who was examined on Ist September, 2008.
Subsequently an affidavit was filed by complainant Smt. Pushpa
before the Additional Chief Judicial Magistrate Ghaziabad denying
the allegation. There was no motive of the applicant to kill his own
daughter. Apart from that he is in jail since 2.9.2008.
In view of the facts and circumstances, without exressing any
opinion on merit it is a fit case for bail. Let the applicant
namely,Ram Bhajan be released on bail in Case Crime No. 276 of
of 2008 under section 307 IPC, P.S. Hapur Dehat, District
Ghaziabad on his furnishing a personal bond with two sureties
each in the like amount to the satisfaction of the Court concerned.
