02. 05.10.2010 Heard the learned counsel for the petitioner

and learned A.P.P. for the State.

The petitioner, Ram Bilash Sah is in custody

since 31.08.2010 in connection with Vigilance P.S. Case

No. 3 of 1986(Special Case No. 11 of 1986) under

Section 120(B), 409, 419, 420, 467, 468, 471 and 477 of

Indian Penal Code and Section 5(2) read with 5(i) (c)(d)

of Prevention of Corruption Act.

The allegation according to the F.I.R. is that

during the year 1978, there was heavy rainfall and for

repairing of damaged houses, Government sanctioned

Rs.75 per house for 117 persons. It is stated that this

petitioner in connivance with other two co-accused

persons misappropriated the relief amount to the tune of

Rs.8,775. It is also stated that 17dead persons were also

given the relief amount on the identification of this

petitioner and the other co-accused persons.

This special case is of the year 1986. It is

stated that after receiving summons, this petitioner

appeared before the Court below on 31st of August, 2010.

The co-accused persons namely Kailash Mandal, the

Mukhiya and Raja Prasad Yadav, Dalpati had already

been granted bail by this Court.

Considering the above facts and circumstances,

the petitioner named above is directed to be released on

bail on furnishing bail bond of Rs. 10,000(Rs. Ten

Thousand) with two sureties of the like amount each to

the satisfaction of Special Judge, Vigilance II, Patna in

connection with Vigilance P.S. Case No. 3 of 1986(Special

Case No. 11 of 1986) on condition that one of the bailors

should be his relation.
