Heard learned counsel for the applicant, learned AGA for the State and
perused the record.
Learned counsel for the applicant submitted that the marriage of the applicant
was solemnized with the deceased in the year 2005. According to statement of
mother of deceased there was no demand of dowry or torture. It was alleged
that there was some dispute in between the husband and wife as there was no
issue to them. He further submitted that applicant along-with his wife was
living separately, however, on the ground of suspicion false allegation was
made by the, informant, father of the deceased regarding demand of dowry
and torture and there was allegation that he was killed by the applicant.
According to medical report, it was a case of hanging. Since there was no
issue hence it appears that she has committed suicide. In the present case, the
applicant is in jail since 5.1.2010.
In view of the above, without expressing any opinion on merit, let the
applicant Ram Brakhsh be enlarged on bail on his furnishing a personal bond
with two sureties each in the like amount to the satisfaction of court
concerned in Case Crime No.847 of 2009, under Section 306, 498-A IPC, P.S.
Kapil Vastu, District Siddharth Nagar.
