Heard Mr. Nishant Srivastava, learned counsel for the
petitioner and the learned Standing counsel.
The petitioner has challenged the order dated 28.2.2010
passed by Civil Judge (Senior Division), Gonda in Regular
Suit No. 66 of 2010, whereby instead of passing order on the
petitioner’s application for temporary injunction, notices have
have been issued to the defendants.
Considering this fact I do not find error in the order impugned,
but keeping in view the urgency shown by the learned
counsel for the petitioner in the matter I hereby issue a
direction to the court below to dispose of the petitioner’s
application for temporary injunction either on the next date
fixed or some other date which shall be fixed within next one
month.
With the aforesaid observation/ direction,the writ petition is
disposed of finally.
