ORDER

1. Leave granted.

2. This appeal relates to the grant of filling up of the vacancy of Modified Ration Distributor in the area in question.

3. We have heard the learned Counsel for the parties and examined the orders passed by the High Court and in view of the submissions now made before us, we dispose of this appeal in the following manner:

All the candidates including respondent No. 1 may make an application for appointment of Modified Ration Distributor before the concerned District Magistrate, Coochbehar within a month from this date. If such applications are filed by the candidates in compliance with our direction, the District Magistrate, Coochbehar shall dispose of the said applications on merits and select the candidates for filling up the vacancy of Modified Ration Distributor in the area in question within three months from the date of filing of the applications by the candidates. While deciding the said applications, the District Magistrate, Coochbehar shall not be influenced by any of the observations made by the High Court in the impugned orders as well as the observations, if any, by this Court in this order and all contentions of the respective parties, viz., the candidates are kept open to be decided by the District Magistrate within the time specified herein above.

5. With these observations and directions, this appeal is disposed of. No order as to costs.
