2. 09. 08. 2010. Heard learned counsel for the petitioner and the State.

The petitioner is apprehending his arrest in a case

registered under Sections 366A and 34 of the Indian Penal Code.

From the impugned order, it appears that two persons

have been charge sheeted. The statement of the victim girl recorded

under Section 164 Cr.P.C. as contained in Annexure-2, reflects that

she fell in love of one Bipin Kumar Sadai and went in company of

the said person for which her parents lodged the present case.

Though victim has expressed her willingness to stay with the boy

Bipin. The victim has not whisper the name of the petitioner.

Considering the fact and circumstances of the case, let

the petitioner be released on bail in the event of arrest or surrender

in the court below within a period of twelve weeks from today, on

furnishing bail bond of Rs. 10,000/- (Ten thousand) with two

sureties of the like amount each to the satisfaction of the Chief

Judicial Magistrate, Darbhanga, in connection with Manigachhi P.S.

Case No. 178/2009, subject to the conditions as laid down under

Section 438 (2) of Cr.P.C.
