This revision filed by the defendant-applicant is directed against
the order dated 5.10.2009 passed by the Additional District Judge,
Deoria in Original Suit No. 133 of 2006 rejecting the application
under Order VI Rule 17 C. P. C. seeking amendment in the written
statement.
Sri Pankaj Agarwal, who has put in appearance on behalf of
plaintiff-opposite parties, states that he has no objection in case the
revision is allowed and the impugned order is set aside and the
amendment application filed by defendant-applicant is allowed.
In view of the consensus given by learned counsel appearing for
plaintiff-opposite parties, revision stands allowed and the order
dated 5.10.2009 passed by the court below is set aside. The
application filed by defendant-applicant under Order VI Rule 17
CPC seeking amendment in the written statement stands allowed.
The court below shall proceed with the expeditious disposal of the
suit in accordance with law after permitting the defendant-
applicant to carry out amendments in the written statement.
