There was direction issued by this Court while accepting inquiry report to pass necessary orders way back vide order dt.18/05/2009 in compliance whereof, the respondents authority failed to pass necessary orders, which has compelled the petitioner to file instant contempt petition. After the notices were served upon respondents, Shri NA Naqvi puts appearance on behalf of contemners and wants time to file reply.
Ordinarily, time is granted by this Court but in the facts of the case, once report of inquiry was accepted, disciplinary authority was under obligation to pass necessary orders in compliance of directions of this Court and there appears to be no reasonable justification for keeping the matter pending for last seven months and particularly when petitioner is going to retired on 31/01/2010.
Before proceeding further, this Court considers it proper to grant last opportunity to respondents for complying with directions of this Court before next date, failing which respondent-1 Khemraj Choudhary shall remain present on the next date alongwith his written explanation for non-compliance of this Court’s order. List on 20/01/2010 as prayed.
