Learned counsel for the petitioners

submits that he has preferred this petition for

quashing of the F.I.R. itself but, as per his

instructions, final report has been given in

the matter after investigation of the case,

therefore, he may be allowed to withdraw this

petition with liberty to file a fresh petition

in case necessity so arises. The prayer appears

to be reasonable.

Hence this criminal miscellaneous

petition is dismissed as withdrawn with liberty

as prayed for.

Consequent upon dismissal of the main

petition itself, the stay application, filed

therewith, does not survive and the same is

also dismissed.
