04 28-09-2010 After some arguments, Sri Subodh Kumar Jha,

learned counsel appearing on behalf of the petitioners seeks

permission to withdraw this application with liberty to raise all

the points, which have been taken in the present petition, or any

other points, if available, before the court below at the

appropriate stage.

Prayer is allowed.

Accordingly, the application is dismissed as

withdrawn with liberty as indicated above.

It is expected that if such petition is filed, the learned

court below will examine the same and pass appropriate order in

accordance with law without being prejudiced with this order.
