learned counsel for the respondents is present who submits that although
counter affidavit was filed in the month of March, 2010 but no rejoinder
affidavit has been filed so far. He further submits that the writ petition is not
maintainable as it is directed against an order passed under Section 41 of the
LR Act.

The writ petition is dismissed in default.
