Allahabad High Court
Ram Narain vs State Of U.P. Thu Secretary, … on 13 January, 2010
Court No. - 24

Case :- SERVICE SINGLE No. - 8624 of 2009

Petitioner :- Ram Narain
Respondent :- State Of U.P. Thu Secretary, Panchayati Raj Department,
Petitioner Counsel :- C.P. Singh
Respondent Counsel :- C.S.C.,R.N.Gupta

Hon'ble Rajiv Sharma,J.

Heard learned counsel for the petitioner and learned Standing Counsel.

With the consent of learned counsel for the parties, the writ petition is
being disposed of finally.

Learned Counsel for the petitioner submits that the petitioner has been
restrained from working as Safaikaramchari w.e.f. 26.11.2009 and as
such, he immediately moved a representation but the opposite parties
did not pay any heed in the matter. Feeling aggrieved, he preferred the
instant writ petition.

While entertaining the writ petition, this Court, vide order dated
24.12.2009, granted time to learned Standing Counsel to seek
instructions but when the case called out, learned Standing Counsel
submits that he has not received any instructions and as such, two
weeks’ further time may be granted to seek instructions.

At this stage, learned Counsel for the petitioner submits that he does not
want to press the relief claimed in the instant writ petition but restricts
his prayer only to the extent that opposite parties may be directed to
consider and decide petitioner’s representation as contained in
Annexure Nos. 9 and 10 to the writ petition, expeditiously, to which
learned Standing Counsel has no objection.

In view of the above, without entering into the merits of the case, the writ
petition is disposed of finally with a direction to the opposite parties to
consider and decide the petitioner’s representation as contained in
Annexure Nos. 9 and 10 to the writ petition, expeditiously, say, within a
period of three months from the date of receipt of a certified copy of this
order and communicate the decision so taken to the petitioner forthwith.

Order Date :- 13.1.2010
