petitioner no.3 prays for extension of time to
surrender in the court below as he failed to
surrender within time due to mental illness.
The prayer made in the modification
application is allowed.
Petitioner no.3 Rajesh Kumar Pathak is
allowed four weeks further time to surrender in
the court below and thereafter he will be
released on bail.
The order dated 21.4.2011 passed in
Cr.Misc.No. 45124 of 2010 is modified to the
extent indicated above.
Let this order including the order
dated 21.4.2011 passed in Cr.Misc.No. 45124 of
2010 be communicated to the court below through
fax at the cost of petitioner no.3.
